The process for public participation in the consideration of variations and proposed plan changes under the Resource Management Act 1991 (RMA) is as follows:
- The Council will publicly notify each variation and proposed change to the District Plan and will invite submissions on the proposed plan change.
- After the submissions close, the Council will prepare a summary of the submissions and this summary must be publicly notified.
- There will be an opportunity to make a further submission in support of, or in opposition to, the submissions already made.
- If a person making a submission asks to be heard in support of his or her submission, a hearing must be held.
- Following the hearing the Council will give its decision on the variations and proposed plan changes (including the reasons for accepting or rejecting submissions).
- Any person who has made a submission on the variation and proposed plan change who feels aggrieved by the decision from the Hearing has the right to appeal the decision on the proposed plan changes to the Environment Court.
