Public Notification of Summary of Submissions Proposed Plan Change No.26 to the Upper Hutt City Council District Plan (2004)

 

Child Care Centres, Kindergartens, Kohanga Reo and Marae

The Upper Hutt City Council gives NOTICE as required by clause 7 of the First Schedule of the Resource Management Act 1991, of the availability of a summary of decisions requested by persons making submissions on Plan Change No. 26 to the Upper Hutt City Council District Plan 2004.

1)	Intent of Proposed Plan Change No.26
Proposed Plan Change 26 reviews how the District Plan provides for child care centres, kindergartens, kohanga reo and marae within the residential sub-zones of the City. Proposed Plan Change 26 seeks to define ‘early childhood centres’ and provide for them as restricted discretionary activities within the residential sub-zones, including allowing for the consideration of traffic effects. The Plan Change does not alter how the District Plan currently provides for Marae within the residential zone as a controlled activity.

3)	Making further submissions
Any person can make a further submission in support of or opposition to anytone or more of the previously received submissions. Further submissions should be made in writing and be in the prescribed form (or to the like effect)  Pre-printed further submission forms are available for this purpose and can be obtained from any of the above locations.

Completed further submission forms may be lodged in any of the following ways:

The closing date for receipt of submissions is 5pm on Friday 21 November 2008.
4)	Process after further submissions close
The Council intends to conduct a Hearing to give those who made a submission or a further submission the opportunity to attend and speak to the Council in support of their submission.  Notice of the dates and times of such a Hearing will be given to all submitters in due course. Any person who has made a submission has the right to appeal Council's decision on the proposal to the Environment Court.
