Public Notification of Proposed Plan Change No.27 to the Upper Hutt City Council District Plan (2004)
Open Space Subdivision Standards
The Upper Hutt City Council has prepared the following proposed change to the Upper Hutt City Council
District Plan (2004).

Intent of Proposed Plan Change No.27
|
Proposed Plan Change 27 seeks to correct an omission in the District
Plan whereby certain forms of subdivision provided for in the Open
Space zone (not including the Speedway area) as controlled and
restricted discretionary activities are not referenced to a
corresponding rule outlining Council’s control or discretion
respectively.
The Proposed Plan Change inserts
a new rule to address this omission by outlining Council’s control over
controlled activity subdivision by replicating a similar rule used
elsewhere in the District Plan, and also amends an existing rule in
respect of one type of restricted discretionary activity subdivision. |

- Inserts
a new rule 21.5A which specifies the matters over which Council
maintains control for controlled activity subdivision in the Open Space
zone.
- Amends rule 21.16 which is applicable to restricted discretionary subdivision in the Open Space zone.

Submissions
|
Any person may make a
submission on Proposed Plan Change No.27. You may do so by sending a
written submission to the Council. The submission must be in Form 5
and must state whether or not you wish to be heard on your submission.

The closing date for receipt of submissions is 5pm on Friday 21 November 2008.

Process for public participation
|
The process for public participation in the consideration of the proposal is as follows:
- After the close of the submission period, Council will prepare a summary of all submissions received.
- Council
will then publicly notify the availability of this summary in the Upper
Hutt Leader. The public notice will also be sent directly to all
persons who made a submission.
- Any person may then make a further submission in support of or opposition to the previously received submissions.
- At
a later date, Council will conduct hearings. Everyone who makes a
submission or further submission, and who requested to be heard, will
be advised of the dates and times of the hearings and will be given an
opportunity to attend and speak to the Council in support of their
submission.
- Council
will give its decision on the proposal. Any person who has made a
submission has the right to appeal to the decision on the proposal to
the Environment Court.
