Public Notification of Summary of Submissions Plan Change No.21 to the Upper Hutt City Council District Plan (2004)
The Upper Hutt City Council gives NOTICE as required by clause 7 of the First Schedule of the Resource Management Act 1991, of the availability of a summary of decisions requested by persons making submissions on Plan Change No. 21 to the Upper Hutt City Council District Plan 2004.

Intent of Proposed Plan Change No.21
The Proposed Plan Change seeks to amend the District Plan in regard to the provision of retailing in the Business Industrial sub-zone of the City, by managing the types of activities, and their scale, provided for within the sub-zone. The Proposed Plan Change also seeks to amend Policy 6.4.1 of the District Plan and clarifies that retailing remains a permitted activity in the Business Commercial sub-zone.
The Proposed Plan Change also seeks to provide for large format or big-box retailing in the area of the former South Pacific Tyres site (as identified in Council’s Urban Growth Strategy document and in the Proposed Plan Change document) by providing for large format retailing as a permitted activity.

Making further submissions
Any person can make a further submission in support of or opposition to anyone or more of the previously received submissions. Further submissions should be made in writing and be in the prescribed form (or to the like effect).
Pre-printed further submission forms are available for this purpose and can be obtained from any of the above Council offices or use the following links.

The closing date for receipt of submissions is 5pm on Friday 3 October 2008.

Process after further submissions close
The Council intends to conduct a Hearing to give those who made a submission or a further submission the opportunity to attend and speak to the Council in support of their submission. Notice of the dates and times of such a Hearing will be given to all submitters in due course.
Any person who has made a submission has the right to appeal Council’s decision on the proposal to the Environment Court. | |
