Plan Change 32 - National Policy Statement - Electricity Transmission
Public Notification of Plan Change No. 32 to the Upper Hutt City Council District Plan (2004):
The Upper Hutt City Council has prepared ther following proposed plan change to the Upper Hutt City Council District Plan 2004:

Intent of Proposed Plan Change No.32 |

Proposed Plan Change 32 seeks to give effect to the National Policy Statement on Electricity Transmission by amending and introducing provisions to recognise the technical and operational requirements of the electricity transmission network, manage activities in close proximity to transmission lines, and provide for the use and development of the electricity transmission network which avoids, remedies or mitigates adverse effects on the environment.
The changes will mean that:
- Earthworks within 12m of existing high voltage transmission lines will need to meet additional permitted activity standards.
- New buildings and structures within 12m of existing high-voltage transmission lines will require resource consent as a non complying activity.
- New buildings and structures within 12 – 20m of existing high-voltage transmission lines will require resource consent as a restricted discretionary activity in the Residential Zone.
- New buildings and structures within 12 – 32m of existing high-voltage transmission lines will require resource consent as a restricted discretionary activity in the Rural, Open Space and Special Activity Zones.
- Subdivision creating a building platform within 32m of existing high-voltage transmission lines will require resource consent as a restricted discretionary activity in the Rural and Special Activity Zones.

Submissions |
|
Any person may make a submission on the plan change but if the person
could gain an advantage in trade competition through the submission,
then the person may do so only if the person is directly affected by an
effect of the plan change that:
(a) adversely affects the environment; and
(b) does not relate to trade competition or the effects of trade competition.

The submission must be in Form 5 and must state whether or not you wish
to be heard on your submission. Copies of Form 5 are available from the
Council and via the website.

Process for public participation
|

The process for public participation in the consideration of the plan change is as follows:
- After the close of the submission period, Council will prepare a summary of all submissions received.
- Council will then publicly notify the availability of this summary in
the Upper Hutt Leader. The public notice will also be sent directly to
all persons who made a submission.
- Any person representing a relevant aspect of the public interest or any
person who has an interest in the plan change greater than the general
public may then make a further submission in support of or opposition to
the previously received submissions.
- At a later date, Council will conduct hearings if needed. Everyone who
made a submission or further submission, and who requested to be heard,
will be advised of the dates and times of the hearings and will be given
an opportunity to attend and speak to the Council in support of their
submission.
- Council will give its decision on the provisions and matters raised in
the submissions (including its reasons for accepting or rejecting
submissions) and give public notice of its decision within 2 years of
notifying the plan change and serve it on every person who made a
submission at the same time.
- Any person who made a submission has the right to appeal against the
decision on the plan change to the Environment Court if in relation to a
provision or matter that is the subject of the appeal, the person
referred to the provision or matter in the person's submission on the
plan change.
